CAR PARK REGULATIONS

AT THE MARENA WELLNESS & SPA HOLIDAY RESORT

of 1 NOVEMBER 2022



§1   

1. These Regulations govern the conditions of using the car park belonging to the Marena Wellness & Spa Holiday Resort managed by KARELMA Sp. z o.o., hereinafter referred to as the Hotel Management.   

2. The car park is not attended, however, it is subject to video surveillance.
§2Within the meaning of these Regulations, the User is the person using the car park (driving the vehicle) or the vehicle owner. If it is not possible to establish the identity of the vehicle driver, it is assumed that especially the person driving into and out of the car park is the vehicle user.



§3               

1. Entering the car park is tantamount to the User concluding a parking space lease contract with the Hotel Management under the conditions laid down in these Regulations.               

2. By entering the car park, each vehicle user agrees to the provisions of these Regulations and undertake to abide by them.               

3. Using the parking space is subject to a fee according to the price list introduced by the Hotel Management and available amongst others on the board at the entrance to the car park.


§4

On the premises of the car park:       

1. There are the rules for the movement of vehicles and pedestrians to be observed, included in the Road Traffic Act of 20 June 1997 (Journal of Laws 2021, pos. 450), subject to the rules resulting from these regulations.       

2. Parking vehicles outside the parking spaces marked by vertical or horizontal lines is prohibited. If a vehicle is parked outside the marked parking space, it can be removed from the car park on the cost of the owner of the vehicle in question.       

3. The speed limit is 5 km/h.       

4. Vehicles transporting flammable, corrosive, explosive and other similar materials and substances which may pose a threat to people and property are strictly prohibited from entering the car park.       

5. The User has to secure their vehicle against theft on their own.       

6. The Manager does not make parking reservations.


§5           

1. The Hotel Management is not liable for any damage caused on the premises of the car park, including damage to as well as destruction and loss of the vehicle.           

2. In particular, the Hotel Management is not liable for:   

a. items left inside the vehicle,   

b. theft of the vehicle from the parking space,   

c. any sudden und unforeseeable events occurring independentlyof the Hotel Management,   

d. bumps and collisions,   

e. damage caused by third parties.


§6   

1. The car park is open 24/7.   

2. The Hotel Management has the sole right to close and to open the carpark in the time periods of their own choosing.   

3. The entrance gate shall be closed for the night, i.e. from 11:00 pm to6:00 am.   

4. Using the car park between 11:00 pm and 6:00 am (entering and leaving) must be reported at the reception of the Marena Wellness & Spa.



§7   

1. The User is entitled to use the car park based on a parking ticket |stay ticket| collected from the ticket machine at the main gate. One ticket entitles to use one parking space, thus allowing one vehicle to enter and to leave the premises. At the entrance, it is obligatory to stop, collect the parking ticket and wait for the barrier arm to fully open.    

2. The parking ticket must be presented upon the check-in at the reception. The receptionist will enter the ticket into the system. The parking ticket allows the User to enter and to leave the premises of Marena Wellness & Spa all throughout their stay.        

a. If the ticket is not presented at the reception upon the check-in, it will be necessary to pay the parking fee according to the price list. Only then can the vehicle in question leave the premises of Marena Wellness & Spa.          

b. If the User fails to present their parking ticket at the reception so that the parking fee can be settled, the parking ticket will be deactivated and the exit barrier will not open.    

3. The Guests using the services provided by Marena Wellness & Spa (bar, restaurant, spa, pool – single or season ticket) may use:       

a. the internal car park (if there is a sufficient number of parking places available) by collecting the parking ticket from the ticket machine at the entrance by the main gate,         

b. the external car park by collecting the parking ticket directly from Security.     

4. If the User loses their parking ticket, they can only leave the car park if the Receptionist consents thereto in advance. In order to be allowed to leave, the User needs to present their identity document, registration card of their car and pay the parking fee.        

a. Losing the parking ticket during the stay: the reception charges the User for parking until the day the User lost their ticket and announced their wish to leave as well as issues a replacement ticket. After having come back to Marena Wellness & Spa, the User must present the new parking ticket at the reception so that it can be entered into the system.        

b. Losing the parking ticket on the check-out day: the receptionist charges the amount due for the whole stay and issues a replacement ticket.        

c. Users who use the services of Marena Wellness & Spa, but not the overnight stay, also collect a parking ticket. If the User using the service of Marena Wellness & Spa who does not stay overnight loses their ticket, they are obliged to pay the full daily parking fee, irrespective of the length of their stay. Once they have paid the amount due, they receive a replacement ticket which opens the exit barrier. 

§ 8               

1. Upon departure, Users shall pay a Fee for using the car park at the reception of Marena Wellness & Spa. The fee amount is calculated on the basis of the price list being currently in force.                

2. Users should stop at the exit barrier and scan their paid parking ticket at the exit machine. 


§ 9    

1. In the event of losing the vehicle keys or locking them inside the vehicle, the User of the vehicle in question must provide the Reception with the vehicle registration card and the User’s ID first and only then can they try to get inside the vehicle. If the User refuses to show the aforementioned documents of if they do not have such documents, the Reception is obliged to immediately notify the police and the car park security about this fact.   

2. In the event of a sudden and justified threat to the health and life of people as well as a sudden and justified threat to possessions, the Hotel Management may remove the vehicle from the car park at the expense of the vehicle owner.


§10   

1. If the User violates the provisions of these Regulations, the Hotel Management may terminate the parking space lease contract concluded with them without notice and with immediate effect as well as apply measures which are necessary to restore the state consistent with the Regulations, which includes removing the vehicle from the car park or mounting mechanical blocking thereon.    

2. In cases referred to in section 1, the User is obliged to cover the costs connected with removing the car from the car park and all the other costs borne by the Hotel Management.   

3. The User is liable for any damage caused by their vehicle or arising in connection with the improper using of the car park, especially for contaminating the car park with fluids leaking out of the vehicle (oil, brake fluid, coolant etc.).    

4. If the costs referred to in sections 1-3 are not paid, the Hotel Management may apply mechanical means of immobilising the vehicle until the amount due is paid. 

§11

Complying with the conditions of the parking space lease contract is controlled all throughout the car park by the persons authorised thereto by the Hotel Management.


§12

In the car park, it is forbidden to:   

1. smoke tobacco and consume alcohol.   

2. litter and damage equipment.   

3. clean and hoover vehicles.   

4. change or refill fluids in the vehicle – coolant, oil, etc.   

5. violate the health, safety and fire regulations.   

6. behave in a way contrary to the social conduct norms or disturb other Car Park Users.


§13

An integral part of the Regulations is the Car Park Price List.
